A new vote presented on Thursday, 17/5, ties the game in the request of operators to avail themselves of satellite connections to serve rural areas, thus fulfilling part of the commitments of the auction of 450 MHz and 2.5 GHz bands, held in 2012. Aníbal Diniz proposes not only to accept satellite service, but any frequency terrestrial network already owned by the telephones, including the 700 MHz.
“In view of the current scenario of technology development for 450 MHz, there is no way to demand that the announcement be fulfilled only by terrestrial networks. I understand that the choice was not business, but because it is use of satellite connections only viable solution at the moment to serve some locations. The request of the bidders should be accepted and I suggest that the technical area verify the fulfillment of the commitments with the use of the satellite and any band held by the provider ”, voted the advisor.
Diniz accompanied Leonardo de Morais on the view that there is no viable supply of equipment for the use of 450 MHz now, not in two years. The deadline was set by the original rapporteur, Otávio Rodrigues, later accompanied by Juarez Quadros, for the companies to complete the terrestrial networks as required in the announcement, while they could still use the satellite. “It is also my understanding that there will be no 450 MHz ecosystem in two years,” he said.
This understanding, however, would imply the return of the 450 MHz band by the companies. The four operators that participated in the 2012 auction, Vivo, Tim, Claro and Oi, allege serious restrictions of equipment in this range and preferred to use other terrestrial frequencies, something already foreseen in the announcement. And they innovated with the use of satellite. But while they ask the agency to accept the change, they also want to continue with the “scorned” frequency.
With this understanding, Rodrigues, Quadros and the specialized attorney’s office opposed the use of the satellite to fulfill its obligations. Leonardo de Morais suggested partially accepting, creating a new system of achievement of goals, but with a sanction proportional to the size of the use of the satellite solution that was not foreseen. Diniz dismisses Morais’ imperfect performance system proposed and guides the technical area to accept any form of achievement of goals.
Emmanoel Campelo, who will be the minerva vote, asked for a view. He said he was sympathetic to the use of the satellite because of the apparent impossibility of using the 450 MHz band. But he understands that if they will not use this frequency, the telephones will even have to return it to Anatel. This is what Morais and Diniz also understand. Teles must end up taking what they wanted, but giving up what they didn’t want.
